Acceptance of Terms
By accessing or using any website, service, software, or digital asset operated by Gravel King Enterprises ("GKE"), its subsidiaries, or its operating divisions (Gravel King Tech and Gravel King Productions), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease use of all GKE services.
These terms apply to all visitors, users, clients, and licensees. GKE reserves the right to modify these terms at any time. Continued use of GKE services following any modification constitutes acceptance of the revised terms.
Use of Services
GKE services are provided for lawful purposes only. You agree not to use any GKE service to: (a) violate any applicable law or regulation; (b) infringe upon the intellectual property rights of GKE or any third party; (c) transmit malicious code, conduct unauthorized access attempts, or interfere with the operation of GKE systems; (d) engage in any activity that could damage, disable, or impair GKE infrastructure.
GKE reserves the right to suspend or terminate access to any service at its sole discretion, without notice, for conduct that GKE determines to be in violation of these terms or otherwise harmful to GKE, its clients, or third parties.
Intellectual Property
All software, source code, documentation, audio recordings, lyric content, brand assets, trademarks, and other materials produced by or associated with Gravel King Enterprises, Gravel King Tech, or Gravel King Productions are the exclusive intellectual property of GKE.
No content may be reproduced, distributed, modified, reverse-engineered, or used in any commercial or non-commercial capacity without the express written authorization of GKE. Unauthorized use constitutes infringement and will be subject to enforcement under applicable intellectual property law. Software licensing is governed by separate license agreements — see the Licensing page for applicable terms.
Software Licensing
Access to and use of GKE proprietary software is governed exclusively by the applicable Software License Agreement executed between GKE and the licensee. These Terms of Service do not grant any license to GKE software.
License keys are cryptographically signed and usage-metered. Any attempt to circumvent license enforcement mechanisms, share license keys, or deploy software outside the licensed scope constitutes a material breach of the license agreement and these Terms of Service, and may result in immediate termination of all GKE services and legal action.
Payment Terms
All fees for GKE services are due in accordance with the applicable service agreement or invoice. GKE reserves the right to suspend services for non-payment. All payments are non-refundable unless otherwise specified in a written agreement.
Payment processing is handled through PCI-DSS Level 1 certified infrastructure. GKE does not store raw payment card data. Disputes regarding charges must be submitted in writing within 30 days of the charge date.
Limitation of Liability
To the maximum extent permitted by applicable law, GKE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, any GKE service — including but not limited to loss of revenue, loss of data, or business interruption.
GKE's total cumulative liability to any party for any claim arising out of or related to these terms or GKE services shall not exceed the total fees paid by that party to GKE in the twelve (12) months preceding the claim.
Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these terms or GKE services shall be resolved through binding arbitration, except where prohibited by law.
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between you and GKE with respect to the subject matter herein and supersede all prior agreements.
